  2. Ola Claudia, My fiance and I about to start a small boat tour business set up as a self employed business. I understand you need the registered a tax number and file for business licence and a name search but can you add any other authorities such as GNR, Maritime Police ect...that should be contacted .We are a Portuguese and British couple moving soon from Canada. Question from matt brasier on 22/02/2018

    Claudia says:

    Hello
Thank you for your question. If you're thinking about register as a self employed you don't need to worry about the name or register the business, you only need to get a Portugueses fiscal number for yourself and start the activity in the finances. After you have your activity registered in the finances you need to contact the local authorities in order to start the process to obtain all necessary licences.

Dear Claudia, Hope you are well, I run a small website design business in south africa and i'm very interested in starting a small web design business in Portugal, i'm aware of the 5000 Euro investment if i want to register a company. Could you please tell me if i need qualifications to start a small web business in Portugal? I only have a diploma in web design from an online company called Alison.Would it be better to apply for a sole trader visa or a self employed person? its all so confusing! Can my dependent incapable brother join me as well as my wife and 2 dependent parents? My brother was in an accident 20 years ago and was clinically declared unable to work. I have the documentation to prove it. Money will be limited so i will have to do this the cheapest way possible. Please advise as there are little information available online on this subject. I will always have an income from my music sales on my website, performing etc. I am also a recording artist, pianist, musician and singer if that could maby open up any immigration avenues to portugal. we are desperate to get out of South africa!!! Thanks in advance and kind regards, Pierre Question from Pierre Smith on 09/12/2017

    Claudia says:

    Hello
In order to start your business you don't need any specific qualification, you only need to know how to do what you will register your company. You don't need 5.000 €, you can have a smaller social capital, but no less then 1.000 € (my opinion) Regarding the decision between a sole trader or a company that will depend on your estimate cost from the activity. Regarding the situation of bring your familly that matter I can't help you because it is out of my range of knowledge.

My clients are in the USA and transactions are sent via paypal or Venmo. What do I need to to or how to I register that I am self employed but not working a “normal” job. Thank you. Question from Emily Kobek on 24/10/2017

I see from your other answers that he needs a Portuguese fiscal number. But sometimes you recommend a sole trader and sometimes to register a company. He's not planning on having any employees for at least the first year. Which should he do, and does he need to establish residency first? Thanks for your help! Question from Rebecca Christopherson on 22/10/2017

    Hello
Thank you for your contact. If you want to develop any business in Portugal you must register either as a self employed or register a company. The diference is that sometimes acourding to the kind of business and the volume of sales is better to register a company then a self employed, as well as the responsability that in a company is limited and as a self employed is unlimited. First you must establish the company only after that can you aplly for residency. If you want more details please send me an email to geral@accountingadvantage.pt

Boa tarde Claudia, My girlfriend and I are going to start a surf and yoga retreat and want to be as environmentally driven as possible: solar power, wind power, own grown vegetables, helping with coastal and local environmental issues etc etc. Do you know where we should start to contact regarding any funding support with regards to this area of tourism? My research suggests that this is a sector of potential growth both on a EU level and at a national level, but tho get the correct accreditation and advice would be invaluable. 20. Hi Claudia, My husband and I are moving to Lagoa in 10 days' time. We want to set up one business that can operate as an umbrella for services including graphic design, honeymoon/holiday rental of one apartment, and wedding car & photography - all linked. There will only be 2 employees - my husband and myself. We already have fiscal numbers. Can we set up an On the Spot Firm with just €360 and our fiscal numbers? We don't need anything else? Also, my husband will get a lot of his graphic design work coming from UK clients - and get paid in sterling, into Uk bank account. We want to leave most of that money in the UK to cover payments back there, mortgage etc. How can we manage the tax situation for this, do you know? And do we register for tax from 1st January? Also, do we have to have a business bank account or can we just use the personal one we opened with Millennium? Many thanks, Amy Question from Amy Grace on 12/08/2017

  24. Hi Claudia, I am interested in opening a hospitality business in Porto and would like to obtain a business loan in order to fund the start-up costs. I am a UK resident and am aware that I will need to get a fiscal number and also apply for residency, however in order to me to have a loan agreed in principle, what steps do I need to take. Alternatively, if this is not an option, could I obtain an international business load from a lender in the UK? I am visiting Porto in a few weeks and would like to best prepare myself for my visit in order to contact the right people and speak with financial advisers. I am also planning on speaking with banks about the best possible financial outcome for my business proposition. Could you advise me further. 27. Hi - I want to teach classes in established organizations in Portugal and my question is about IVA. Do I provided an invoice that includes my hourly rate, or an agreed amount per month, and then add IVA? Can you direct me to an example of such and invoice online? Thanks John Myers Question from John Myers on 22/02/2017

    Claudia says:

    Hello
Thank you for your question. In order to perform any activity you must first register as a self-employed, in your case it is the best solution. After that you will determined if your services will be superior to 10.000 € or not in order to become you subject or not to VAT. If you are subject to VAT then you must calculate your hourly rate and only after apply VAT. You can pass the invoices directly on the website from the finances. You can speak with us in order to help you with the process.

Also, do you know usuall, average expences for these things (so I can calculate with more precise numbers)? Obrigado muito, Lukas Question from Lukas Palan on 11/02/2017

I am living in Portugal with a permanent residency and I am registered as a sole trader (recibo verde), for the start I do not want to resister with a company and continue as a sole trader. My question is what are the legal requirements for me to start selling a product, do I need to register a product somewhere, do I need a licence? Thank you, Aire Question from Aire Partel on 05/01/2017

    Claudia says:

Hello. Thank you for your contact. If you are registered as a sole trader, and I believe with a CAE that allows you to sell your product, you don't need anything else in terms of the business. In order to sell you need to pass na invoice or a receipt. The receipt you can do it on the finances portal, the invoice must be a certified software to produce. If you need anything else please send me an email to geral@accountingadvantage.pt

I am currently developing a mobile application I hope to commercialize in the nearest future, and I would like to register it as a business here in Portugal. I have had an appointment with SEF and I have been issued a residence card, but I was told that I would not be given a fiscal number in the first year of my stay in the country. Can I still register and operate my business here in Portugal? If I can, How can I go about it? Also Does Startupoverseas.com assist in registering businesses? You can get a Portuguese fiscal number, in fact you should already have one. Only after this can you register your company. We can help you with the registration and with the fiscal number. In order to protect your branch my advise is for you to consult the website of INPI http://www.marcasepatentes.pt/, and check the costs for patent or trademark
Please send us an email if you want to proceed with your company, in order for us to send you our fees
    Thank you

Thank you Question from Polin Lidan on 26/05/2016

    Claudia says:

    Hello
Thank you for your contact. You should register a limited company, you can't do it online, you must come to Portugal. This is a 2 step situation, first get the portuguese fiscal number and then register the company. You will only need your passaport and proof of your adress in the country you live like a water built or something like that. The time you will need on the first day to get the portuguese fiscal number and the next day to register the company and open a bank account. The register costs 360 € and then you have the accountancy services. If you want to receive our quotation for that please send us an email to geral@accountingadvantage.pt

  46. Hi, Can you please advise me on what i need to do to open a Strip Club/Lap Dancing club in Portugal? I cannot find what type of licence i require, and is it easy or hard to get? Question from Marcus Lucas on 20/05/2016

    Claudia says:

    Hello
Thank you for your contact. Regarding any activity that you want to develop you need first to register a company. Only after you have a company can you start an activity. Then you must find a place, and usually the places already have licences to develope some activities. If the place you want doesn't have the licence to develop the activity you want you must ask the city hall of the place you are in to give you the licence. They will analise your request and provide you with that. Usually it is not a dificult process. Also on line you must comunicate 30 days before open that you are going to open.
We can help you with the register of the company and provide you all the information you need. Please send us an email to geral@accountingadvantage.pt

  47. Hi Claudia, I am Portuguese and my husband of 16 years is Israeli. My residency is in Portugal but because my husband works in Israel I travel back and forth. He wants to open an online business in Portugal, it’s a website where people can buy products online around the world. The idea of opening this online business in Portugal instead of Israel it’s also because we want to get him residency and get his paperwork going. After 16 years of marriage and 2 kids it’s about time we see to that. My question is, is it possible for him to do so? Where can I do it and what documentation do we need? Thank you! Elisabete Question from Elisabete Cohen on 17/05/2016

    Claudia says:

    Hello
    Thank you for your contact
It is not easy to get residency, but also that is a process a part from register a company and must be done by atourneys.
Regarding the register of the company he can always start a business, the only thing that is needed is the portuguese fiscal number and 360 € for the register
We can help you with this process if you want but please send us an email to geral@accountingadvantage.pt, in order for us to discuss all the details

There are five of us, myself, wife, 21 year old daughter her fiancé but due to get married and there 1 year old son. The turnover and profit will be small, what is the best way of setting this up, as a sole trader or company and what social and tax payments would be involved. We have saving so can buy business and have money to last several years to get established. Please can you help Thanks Mark Balson Question from Mark Balson on 01/05/2016

    Claudia says:

    Hello
Thank you for your question. Probably the best way to start this is as a sole trador with organized accountancy, because only this way can you be taxable over your profit. If the business grows you can register a company and close the activity. Since I believe it is the first time you will register as a sole trador in Portugal you will have 1 year isemption regarding social security. I can provide you our proposal for accountancy services if you want. Please send me an email to geral@accountingadvantage.pt

Hi Claudia, I am looking for some advise on either setting up a business in Portugal or expanding an existing UK based Ltd company to operate in Portugal. i am interested in the tourism industry in the algarve area, and would like to look at possible financial help to get started and the process to follow to either get a company registered or use the existing company details. from looking through your responses below it seems fairly easy to register the company, but if you could advise on where to start with some info this would be greatly appreciated. Thanks Question from Richard Kidd on 13/04/2016

    Hello
Thank you for your contact. In fact it is much easier to create a new company then to open a branch from an existing company.
In terms of getting support for the business the fund that you can apply is Portugal 2020, because in terms of bank loans they are not provinding financing for new companies.

  52. Dear Claudia, we are B2B Tech Company in retail segment. Our head office is in UK (and mother company is in Delaware) but we are considering to open another office in Portugal. This office would be used for the relocation of Tech and R&D team (closer to clients, good climate and affordable way of life). So most of the time it would not be profitable and UK company would send the money to pay salaries, rent and other costs Most of our contracts with clients will be signed with UK company Can you please advise about: - The most convenient organisation form of the business in Portugal? - Should we make a mother-daughter link between UK (or Delaware) and Portugal companies or it would be better to make it independent? - Is there a double tax treaty (between UK and Portugal, if we sign some contracts with European clients through Portugal entity)? - Most of our Tech team members are from Russian Federation what should they do to obtain visas? - Is there any support (tax, grants, etc.) that such company can use? 54. Hello Claudia, I am a recently retired research & development scientist exploring the possibility of starting a business in the health care industry. Portugal is at present uniquely placed within the EU for the particular field of care I am experienced in. At this stage I would be very grateful for any initial guidance regarding the application process needed to obtain pilot/startup funding. Although embryonic I believe the need/demand for this sector of the health care industry, if proven successful at pilot scale, could be rolled out to all EU member countries and beyond. I look forward, with interest, to your reply. Thank you for your time. Regards, Andrew Question from Andrew Thayer on 30/01/2016

Thank you for your contact. I'm not an atorney in order to provide you the correct information, but I think that if you're not in Europe, you must first aply for a tourism visa to come, and once you're here and open your business or get a job can you aply for residency.
My advise is always for you to contact a lawyer in order to provide you more info about residency

  70. Hi There Claudia, I would like to know how can a UK registered company buy a building in Portugal, without having a business there. Is this possible? If so what are the legal requirements to do so. Many Thanks for any help. Pedro Question from Pedro Santos on 21/09/2015

    Claudia says:

    Hello
Thank you for your contact. A non-resident or a non-resident company can perform activity in Portugal, but all the income obtained here must be taxable here. In terms of buying you don't need to worry, only if you sell or rent the property, then you obtan income and are taxable for it - 25% to 28%

  74. Hi Claudia, we are setting up a small business which will involved a good deal of our savings to set it up the yearly income will be some like 20,000 E annum. It is lawn bowling for expats and holiday makers is there a way of avoiding paying VAT on sports ( bowling ). If not how long will it take before we need to pay it. We are planning on charging only a few euros per two hour game. We are going to be a separate division totally independant on an already established sports centre which does not offer this facility Question from Gwendoline Crowther on 08/07/2015

    Claudia says:

    Hello
    Thank you for your contact
Regarding your question the VAT that you will charge is 23%, but if you open your activity as a self employed and since you're telling me that you will charge few euros, if your total income is inferior to 10.000 € per year, no more than 833,33 € per month you can be VAT isempt.
If you have any more questions or need help to register your activity please send us an email to geral@accountingadvantage.pt

  75. Hello Claudia. We are planning to open a restaurant in Lagos, and your advice would be really appreciated. It would be useful to understand the benefits/disadvantages of being self employed or setting up a company. For example, If we set up as self employed, would we able to employ other staff or would we have to form a company to employ people? We are in the early stages of writing the Business Plan to approach the Bank for funding. Thank you for your help. Question from Sue Pyatt on 12/06/2015

    Claudia says:

    Hello
    Thank you for your question.
You can employ people either as a self-employed either as a company. The only thing is that if you are a self-employed and employed someone from your family the cost is not acepted and if you are a company that cost will be totaly acepted. Also in terms of social security if you are a company the value will be calculated over your salary if you are a self employed it will be calculated over your sales from the previous year, on the fisrst year you will be isempt if you are a self-employed. The register of the company will cost you 360 €, the register as a self-employed is free of charge. The tax over the profit of the companies is 21 %, in terms of self-employed the tax will be over the income you will have as a person trought the year and it goes from 14% until 48%

    Claudia says:

    Hello
Thank you for your question. If you are selling from the UK to a Portuguese company you don't need to register in Portugal. The only thing you need to check is if the company is a VAT subject in Portugal and check their fiscal number on the VIES website, in order to isempt yourself from VAT or not.

  88. Hello Claudia, I would need help to a company constitution in Portugal. I am Laurencia Omoregie a british citizen. I alraedy have a parent comapny here in the UK. I want to know the best way either to open a new company or to have a branch in Portugal. I will be intersted in healthcare and nursing supplies. The parent company presently deliver nursing services and supplies in the UK. i wait for your reply. I have a numero contribute number(Fiscal number) Question from Laurencia Omoregie on 01/03/2015

    Claudia says:

    Hello
Thank you for your contact. Regarding your question a new company is much more easier to make than a branch. For a new company you only need to have a Portuguese fiscal number and with that you can register the company. A branch you will need to have a minute from the mother to authorize the register here and all the documents form the mother translated and notorize by our embassy in the UK. So if that is not that important to you my advise is always a new society. If you have any more questions please send me an email to geral@accountingadvantage.pt.

    Claudia says:

    Hello
Thank you for your contact. Regarding your question, it is not mandatory that only because he opens a company he will get a visa. He must come to Portugal with a business visa issued in his country, then he can open a company and aply for a residency visa in Portugal, but with no guarantees that he will get one.
Once you are here you will get a Portuguese fiscal number and in the next day you can open a company.

  92. Hi Claudia, I want to start a business as a sole trader importing a product from the UK and selling it in Portugal from a website. Would it be best to register in the UK or Portugal? If in Portugal what legal steps do I need to take to do this and will I be required to deposit €5,000 in a business account before I start trading? I am a British citizen living in Portugal. Thank you. Question from mandy winkworth on 16/01/2015

    Claudia says:

    Hello
Thank you for your contact. If you want to sell your products in Portugal you need to register here. You can register a company, but only a deposit to open a bank account is needed (150 € most banks), social capital 1 €, and 360 € for the register. But you can register yourself as a self-employed; this decision will depend on your business. Any further question you can send me an email to geral@accountingadvantage.pt

  93. Hi Claudia, I am currently self employed as a virtual assistant in the UK and am planning to move to Portugal early next year. I hope to move the business with me and to continue to work remotely for customers in the UK. I have been advised by HMRC that I am not able to stay registered as self employed here. I am currently trying to contact them to find out about setting up as a limited company here and working (as the only director and employee) in Portugal, I will continue to try to speak to them. I just wanted to check what I believe to be the main barrier to me setting up in business in Portugal. I believe that if I were self employed in Portugal I would be liable to pay social security contributions of €130 per month (€1560 per year). As I only run my business part-time and am still getting established, my turnover this year will be less than £4000 (approx. €5000). In this case, the social security costs would be approx. 30% of my total turnover, which has led me to conclude that it is not viable to register the business in Portugal. If this is correct, and I am unable to register as a limited company in the UK, I feel that I would have no other choice than to wind up the business. This is disappointing as I want to work, I am just getting established, and my customers have just begun to trust me and rely on my work. Can you please advise if there are any other solutions you can think of? Thanks, Pamela Smith Question from Pamela Smith on 23/12/2014

    Claudia says:

    Hello
If you want to register as a self-employed in Portugal, and it is the first time you do it, you have 1 year exemption of social security. This year would help you to establish. If you have any more doubt please send me an email to geral@accountingadvantage.pt

  94. Hi Claudia, first of all, thanks a million for the relevant information you gave on this website. Well, my question is regarding the amount of money that "goes away" with taxes from the raw income of a LDA company in Portugal. If I open a company in Portugal with only me as a employee, I could expect (from the clients I already have) an income of 1200 to 1500 Euros per month, how much is the percentage of taxes deducted to keep the company perfectly legal and without any issues approximately? 10%, 20%, 25%? I'm a Portuguese citizen living abroad for a long time and have no idea if it is viable to move back to Portugal and just do what I do as a freelance today in Portugal instead of Ireland. Question from Gustavo Silva on 28/11/2014

    Claudia says:

    Hello
Thank you for your contact. Regarding your question if you create a company and give yourself a salary of 1200 € you can expect to earn that amount less 11% of the value for social security and 15,5 % (not married with no kids) for IRS, so total 882 €. The company will have to pay 24,75% over the amount for social security, so total cost for the company is 1497 €. The company will also pay 17% over the profit
If you have any doubt you can send me an email to geral@accountingadvantage.pt

  101. Dear Claudia, We are two Estonians who would like to start selling sports related goods in Coimbra (e.g. drinking bottles). We already have a Portuguese fiscal number, but we would like to know that what would be the next step and how much would it approximately cost? As we are not staying here for a very long time, would it be better to register ourselves as self-employed instead of setting up a company? Thank you in advance! Question from Triin Eerme on 13/09/2014

    Claudia says:

    Hello
Thank you for your question. Deciding between opening a company or open an activity as a self-employed must be analyzed in terms of income and expenses. Right now the tax of the companies can be less than the tax of a self-employed but as I refer we must analyzed your plan for the business in order to tell you the best solution

  102. Hi Claudia, We are two partners with a very long experience in hospitality and travel who would like to buy, renovate and open a hostel in one of the vacant run-down buildings in Portugal (considering Lagos, Peniche, Porto or Lisbon). Neither of us speak Portuguese but once started we would initially manage and operate the hostel ourselves while also residing on the premises. Could you please kindly advise me on: How difficult is the administration process of obtaining all the licences? What type of company would be the best considering any tax breaks? How much tax would apply to our income (residing in Portugal) and what is the property or other applicable taxes? Thank you very much. Mike Question from Mike Cesnak on 04/09/2014

    Claudia says:

    Hello
Thank you for your contact. Regarding the licensing process there is a law that defines all characteristics Portaria n.º 327/2008 from 28th of April, you will probably need help in this field (engineer or architect)
My advice in terms of company for this business is a limited company. In terms of your tax as residents that will depend on your income, in terms of property's that will also depend on the evaluation from the finances, in terms of profits of the company is 17% until 17.000 € of profit and 25% applicable to the difference.

    Claudia says:

    Hello
Thank you for your question. The procedure of creating a new company in Portugal is initiated and concluded on the same day, on an unique place (conservatory), unless you need to get first a Portuguese fiscal number and in that case it will take two days. You can decide if the society is built with 1 partner or two or more partners. One must be nominated the manager
The register costs for opening a new company are 360,00 €.
We can exchange more info throught email geral@accountingadvantage.pt

    Claudia says:

    Hello
    Thank you for your question
In order for me to help you, there are some situations you should define, like where do you want to start and what kind of sports, because without this elements I can't see what type of license is needed or if the district where you plan to do your business will approve.

  108. Hello Claudia We are hoping to let out our apartment in Lagos, Portugal. Can you please advise what percentage of tax we would be required to pay on rental income and also what expenses we can offset against this tax. We are UK resident. Many thanks Lolk Question from Lol Kellman on 04/04/2014

    Claudia says:

    Hello
Thank you for your question. You can choose between a tax of 28% over rent profits or if you deliver your tax income in Portugal you can put it together with your income, and be taxed according to the total amount of income. If you deliver your annual tax declaration in the UK you must declare this income as obtain abroad and prepare to pay more or less between 25% to 28% of the amount.
The expenses are works in the apartment, the tax you pay over the property (IMI), and nothing else.

  109. Hi, I'm writing a financial business plan for beach bar in Portugal - Algarve. I'd like to start to collect information about issues like: cost of licence, how long bar can be open (as I know bars can be open only untill 2 am.) I'd like to built the bar, not only rent the place so how long it can take around to get permission to build. Question from Barbara Dudko on 28/02/2014

    Claudia says:

    Hello
Thank you for your contact. In order to know the licensing prices you need to know how big it will be your bar and the localization of it, and that information you can obtain in the city hall.
Regarding permission to build everything will depend on the place you want to build.

    Claudia says:

    Hello
Thank you for your contact. That is a very difficult question, because it will depend on the place you want to open the business and the amount of investment. It will also depend on the experience of the person that is going to start up the business.
Based on this could you please tell me exactly what are you thinking with this question? You can send me an email to: geral@accountingadvantage.pt

  114. Hello Claudia, I am a farrier (ferrador) and i travel to my customers house or stables. I understand that in Portugal i need to have a list of everything that is in my work car (tools, horseshoes etc.) is this true? Where can i find an example of the kind of paperwork i need to use for this? Also, i am selling products via a dutch webshop to people in Portugal, do i need to charge portuguese VAT 23% and declare it in Portugal or Dutch VAT 21% and declare it in Holland? Kind Regards, Paul Question from Paul Clark on 11/11/2013

    Claudia says:

    Hello
Thank you for your question. Regarding the transport of tools that allows you to do your work, you don't have to have a transport guide, because that belongs to your activity, I think you are a self-employed here in Portugal correct? Regarding the product that you're going to sell, like horseshoes, you should have a transport guide, when you carry those products to the clients. You should ask for your accountant help, if you don't have an accountant, you must see how you pass the invoice, if it is manual or through certified software and proceed the same way regarding the transport guides. Regarding the second question, if the products you sell are in Holland and come to Portugal, you should charge the VAT from Holland, or apply the rules of exemption if it is a sale to a VAT subject in Portugal.

  115. Hi Claudia I am very keen to start importing Lactose free cheese which I recently discovered in Portugal to the UK. I am in talks with the Portugese retailer at the moment who has supplied me with the supplier and is being very helpful. I am wondering how I can find other Gale or Albuferia based companies who import refrigerated products into the UK already? What legalities are required regarding fiscal numbers etc as I will be trading from the UK not Portugal. Many thanks for your time. Petra Agnew Question from Petra Agnew on 07/11/2013

    Claudia says:

    Hello
Thank you for your contact. Regarding contacts of companies my advice will be looking at the internet, probably you will find what you're looking for. Regarding the legalities, if you're going to trade from the UK, I believe the only connection with Portugal will be the purchase, so if you're register in the UK that won't be a problem.

  116. hello, planning to open a healthy food cafe in Baleal...where shall I start ... seting up a company first or finding property...I might think of renting food trailer yet not sure where I can find them in Portugal , and the renting parking space but preferably renting/buying a property will be better...thank you for advice..regards Anka Question from Anka Kun Kun on 02/11/2013

    Claudia says:

    Hello
Thank you for your question. My opinion is find a place first or define first what you want to do, after that make the company, because if you make the company first you will start to have expenses without making any Money. I think renting a place will be better for you, if you really want to make your own business. We are available to give you quotation for accountancy services, and help you to make the company.

I would like to know where to start, and what loan is the best suited for my ambition. How much own capital do I have to have in order to get a loan etc. Best regards Niko Question from Niko Lind on 29/09/2013

    Claudia says:

    Hello
Thank you for your question. In my opinion the first step is to know what costs are we talking about. What is the amount needed, the hotel exists or not, and after that make a project, where you identify all the costs and revenue. Only with that study can you ask for a loan. Since your area is tourism we can even see if there are loans specific to that, usually with better rate. If you need any other details you can contact me through email to geral@accountingadvantage.pt

Is it possible for me to own a business in Portugal and work in that business? Will owning a business make residency applications easy? Thanks so much! Question from Chloe Gil on 23/09/2013

    Claudia says:

    Hello
Thank you for your question. Yes it is possible to have your own business in Portugal, and with a company establish you can ask for residency visa, you also have to make your discounts in Portugal and have a house (rented or not). 124. Hello Claudia. I am a UK citizen who is currently working in the Algarve in Portugal. I am interested in starting a mobile juice bar business here. I am based in the surfers area of the algarve near the beaches of carrapateira, amoreira and arrifana (a national park) 40km from Lagos. I was wondering where I start in regards to registering myself as self-employed and having the correct licenses as a foods and beverages vendor. Also I am aware that this area is a national park and so the beaches are protected and this may be "red taped", however there are other businesses flourishing in this area and there is a real gap in the market for this kind of enterprise. We would be promoting a healthy, environmentally aware enterprise with recyclable packaging and a message of preservation of this beautiful area, but who would we contact in regards to legally be allowed to park in a close proximity to these beaches? Any help greatly appreciated!! Question from Corrina OBrien on 10/09/2013

    Claudia says:

    Hello
Thank you for your question. Regarding the register as a self-employed, you can make it in the finances, although my advice is always to speak with an accountant to see what will be the regime you should have. We are available to speak with you about this, contact +351 932 888 808 or +351 219 586 265. About the licensing is always on the city hall. The mayor will approve or not your project, you must fill a form with some information about it. We can help you with this project. Contact us.

Victor Question from vitor alves on 17/07/2013

    Claudia says:

    Hello
Thank you for your contact. In order to have a business you must either open an activity as a self-employed or open a company. I believe to start, you can register as a self-employed with organized accountancy, in order to consider all your investment as a cost. The costs of this are the cost of social security, minimum 150 € every month, and an accountant, and the value will depend on the work. The accountant will open your activity, and then you must have a shop and buy the material of course. If you want we can take care of the process, just contact us to our email geral@accountingadvantage.pt

  130. Hi Claudia I and 2 friends of mine (US citizens) would like to start a retreat center in rural Portugal. We are most concerned about appropriate visas. We are uncertain of the steps involved in gaining appropriate visas for residency (do we have to do this before we purchase property, do we need visa to purchase property, what if we are denied residency after we purchase the property). What can you tell us about the risks? We don't want to buy property and begin work if the chance of obtaining residency is poor. Thank you for your advice. Sophia Question from Sophia Cook on 02/05/2013

Hello. Thank you for your question. Regarding the Visa, only after you made the company and show economic sustainability, may we apply. 131. Hello there Claudia, I currently live in Montreal and was thinking about opening a hostel in Portugal (in fact I have thought about it for a while). However, I am hesitating, first because the financial opportunities seem a lot more viable in Montreal and I am under the impression that a country will not receive a foreign entrepreneur as well as a homeland. I should probably specify that I qualify for financing in Quebec since I am under 30. Are there any financing opportunities for businessmen and women from overseas within Portugal? Obrigada Question from Harmony Marin on 30/04/2013

    Claudia says:

Hello. Thank you for your question. To be honest with you, the economy in the UE is facing a dark period, and Portugal is really a challenge for companies. The financing opportunities are quite low, but still possible in some sectors, and tourism is one of them. There is no country in the world that welcomes the foreigners better than ours ;), and our company would help you in the entire process of your business and staying in Portugal. But if you already have an investment in Montreal, and have nothing to start from in Portugal, my business opinion is for you to invest in Montreal, although my heart really hoped that you could invest here. If you need anything else from me, you can send me an email to geral@accountingadvantage.pt

  132. Hi Claudia, My name is Patrick, and I live in London at the moment. I have lived in Portugal for eight years, enough to fall in love with the country. Especially the silver coast which I believe is an amazing piece of nature and quite frankly unique in Europe. I have inherited the house of my grand father, again a unique location, very close the small town of Caldas da Rainha. I want to bring British tourits up to this place, show them the landscapes, the beaches, make them taste the food, fresh fish, gorgeous wine and so on. I would be their guide, their host and their sommelier, for a new, and avant gardiste holiday package. Those are nice words, but how do I get started?? Question from Patrick Alves on 12/04/2013

    Claudia says:

    Hello
Thank you for your contact. Yes I understand why did you fell in love with Portugal. It is the most beautiful country in the world (it is mine, lol). You can start doing this activity opening as a self-employed or open a company. I think probably, and just to see the impact of the business you should be a self-employed with organized accountancy. The following steps are making a website and advertise your business. You can count on us to help you with the entire process. You can contact me through my email geral@accountingadvantage.pt

  133. Hi, My name is Mery, and I am currently looking at setting up our own business in Portugal, possibly a small coffee shop to begin, with a view to expand. I am currently looking for an area where I could possibly benefit from both the tourist and local market. I would appreciate it if you could send me some detail on the typical cost of setting up, rates and anything else you feel would be relevant. Regards Mery Question from mehrashoub jadidi on 02/04/2013

    Claudia says:

    Hello
    Thank you for your contact.
First of all it is very important for you to have an idea of the place you want to establish your business, because the prices will depend on it. If you want to open a small coffee shop my advice is to open your activity as a self-employed with organized accountancy, the costs are less.
If you choose Lisbon, you have in terms of tourism, Baixa Lisboeta, Belém, Cascais, these are more expensive areas, but with a lot of tourism. Sintra is very nice too, but as I told you the prices will depend of the area of the place and the localization.

  135. Good afternoon, I was looking for some basic information on how we would go about setting up a business in Portugal? Who would we contact? Can this be done from the UK? What kind of admin costs would we be looking at? What issues might we encounter? I understand there is the service 'Empresa Na Hora ', so how would we go about utilising this, if we are able to. Any information would be greatly appreciated. Many thanks Chris Question from Chris Kinnaird on 21/03/2013

    Claudia says:

    Hello
    Thank you for your contact.
To open a company in Portugal, you will need to make the register in Empresa na Hora. The managers of the company need to get a Portuguese fiscal number. You can make this from the UK, but only if you have a person here in Portugal with a power of attorney, with powers to make the company, that is a litle more complex, so I advise you to come and make it. The process only takes 2 days, one to get the Portuguese Fiscal number and the other to register the company. The cost of the register is 360 €, and the fiscal number is 11,00 €. Our company provides the accountancy services and the constitution of the company. I will send you an email with the costs
    Kind Regards

Hi, i am from Pakistan and living in uk for 2 years. i want to move Portugal to open a company. i want to know how much investement is required to start a business. i want to open a small company where 5 to 6 people would b working fulltime. i am going to apply for schengen visa and will visit Portugal soon but i want to know if i open a company there how long will it take to get a residence permti. please help me, waiting for your response Thank you. Question from muhammad waseem on 15/03/2013

    Claudia says:

    Hello
Thank you for your question. The expenses regarding a business are variable according to the business. If you need to have a warehouse the cost of it depends on where and how big it will be. The register of a company costs 360 € and to get you a Portuguese fiscal number cost 11,00 €.
Regarding the residency visa, we have no information about the time of approval, but never less than 3 months. The application to residency visa is made by attorneys. CEF, will then analyze your application and decide to give you or not the residency Visa.
    Regards

  147. Dear Claudia, I would like to setup an On-The-Spot company.I am currently running a business in Ireland but am seeking to register a business in Lisbon. This description sounds most suitable to me : "On-the-Spot Company It is possible to create a company (LDA or SA) with a single day in Portugal. Actually, it's possible to establish yourself in just over an hour. This is achieved through a one-stop office. Investors will no longer have to obtain in advance a certificate of company admissibility from the National Registry of Companies (RNPC). Nor will it be necessary any longer to sign a public deed, except in certain cases. During the incorporation process, the definitive legal person will be identified, a Social Security number will be issued, and the business will immediately receive its memorandum and articles of association, and an extract of the entry in the Commercial Register. These steps are a way of contemporising administration, and they are the inaugural move toward a simplification between business and public admin. Portugal is consequently one of the most efficient locations in Europe to establish oneself: Streamline set-up (little more than an hour Distinctly less bureaucracy and red tape (a single application form) One of the cheapest, standing at approximately 360 Euros In half a year in 2005, over 1000 businesses successfully utilised this approach. It is a welcome addition to Portugal's business environment and is a veritable innovation in fats-track entrepreneurialism." Do you know of any companies who will assist me in doing this? The tour would run between Porto and Lisbon on a UK imported bus (which would stay in Portugal year round). I need to know the requirements legally in order to make this happen. Thank you very much Liz Question from Elizabeth Brookes on 22/05/2012

Since you're not selling to the portuguese market you don't need to open an activity in Portugal, but if you start selling the tour in Portugal, you will need to be either a self employed or a company. Also the trailer is UK registered at present but I am thinking to work here for 6 months only per year, returning to the UK for 6 months. Will I need to import the trailer via IMTT to do this or can I work for 183 days here, with an ambulent licence and pay tax for 6 months here only and 6 months in the UK? Question from Tracy Oldham on 10/11/2011

    Claudia says:

    Hello
Thank you for your question. You don't need portuguese residency to start a business or to come to Portugal, since you are a British citizen, you will only need a fiscal number. You come to Portugal to develop an activity, so you must register as a self employed and you must pay taxes from the time you will be here developing your activity.

  178. Hi there i was wondering if you are able to assist me please. I am from the uk and would like to open up a business in Portugal a restraunt. Am I able to get a business loan from banks in Portugal or do I need to get a business loan from here. Also in my business i also wanted to have a shisha bar do you know if there are any laws prohibiting me from making the outside of my restraunt into a shisha bit. lokking forward to your reply panna Question from panna patel on 19/07/2011

    Claudia says:

    Hello
Thank you for your question. Regarding your question, to get a loan here in Portugal you must have your company, and without a backround it is complicated. Probably is easier to get in your country, where you have your historial. We will need to speak about the shisha bar.

  179. Dear Claudia, I am enquiring about starting a Yoga Holiday enterprise in Portugal starting next summer and was wondering how do I go about developing this idea into reality. Any information you can provide would be very helpful. Kind regards Grainne Coyle (Ireland) Question from grainne coyle on 30/06/2011

    Claudia says:

    Hello
Thank you for your question. Your question is very vague, I believe that the first step is to think of a location, because the concept is quite unic. Probably you will need a business plan.
The constitution of the company is easy. Please feel free to contact me, so we can discuss your idea
    Kind regards

  180. Dear Claudia Many thanks for explaining the position regarding VAT and the fact that it is not charged on any purchases of real estate in Portugal. You do, however, mention IMT in your last answer, which I think is a Property Transfer Tax. Within Portuguese tax law, are there any circumstances at all in which it is possible to get a refund of IMT from the government? e.g. the property is being purchased by a non-resident for business purposes? Many thanks Geoff Question from Geoffrey Say on 21/06/2011

    Claudia says:

    Hello
The IMT is a non refundable tax, you can't ask for the return.
    Regards
    Cláudia Azevedo

  181. Dear Claudia Thanks for your last answer. However, I don't understand what you mean when you say I am "VAT isent"? Also, my question really related to the IVA status of property transactions. Does IVA get charged on any property transactions in Portugal when the property is for business (not residential) purposes? Many thanks Geoff Question from Geoffrey Say on 15/06/2011

    Claudia says:

    Hello
When you buy a house for whatever purpose, there is no VAT. You pay IMT and not VAT.
Even if you are a company and buy an property, there is no VAT, because you pay IMT
If your house is not for permanent residency, you will also pay IMI, which is anual tax and depends on the value of the house. Hope to be clear

  182. Dear Claudia I purchased an apartment in Portugal in May 2010 which I rent to tourists as holiday accommodation. The property was constructed in 2007 and the developer rented out the property to tourists before selling it on to me. My purchase contract simply discloses the price I paid, without any mention of VAT. Given that I purchased the property as a business venture (i.e. to rent to tourists), I have questioned the VAT-status of this transaction. The vendor has stated that "in Portugal, VAT is not due on the purchase of real estate properties and therefore there was no VAT included in the purchase price of your property". However, in the UK, holiday accommodation does attract VAT when purchased, provided that it is less than 3 years old. Does the same VAT rule apply in Portugal? Assuming that the VAT rules are consistent and given that the property was being purchased for business purposes, should the vendor have charged VAT, or can I assume now that the purchase price did actually include Portuguese VAT? Thanks Geoff Question from Geoffrey Say on 15/06/2011

    Claudia says:

Hello. Thank you for your contact. When you purchase an apartment you pay IMT which is a tax relative to the aquisition of houses. For these reason you are VAT isent. If you have any more question please don't exitate.
    Regards

  183. Dear Claudia We are just about to sell our home in Portugal, we have owned it for 5 years, having fully restored it 2 years ago. it is our main residence. we will be buying a house in another eu country with the money from the sale of this house. what tax will we need to pay on the profit from the sale, the difference between purchase price and restoration costs is a lot compared with the sale price. how do we register our intention to reinvest, to avoid paying capital gains tax? thank you charlie Question from Charlie stone on 27/05/2011

    Claudia says:

Hello. Thank you for your email. If you sell your home in Portugal you will have to fill an income declaration (IRS - Appendix G), and there you declare your intention to reinvest. But this house that you are going to sell and the house that you are buying must be your fiscal address, if not you can't declare the reinvestment. I'm available for any other question

  184. Dear Claudia, In 2007 I was advised by a lawyer in Oporto to set up a company since it was my intention to buy and renovate ruins. We set up an SA and I bought 2 ruins. Unfortunately, with the economic crisis in 2008 my resources were affected plus the architect appointed has taken 3 years to obtain planning. (He was not a real architect, I later discovered.) I have had all sorts of problems with my representatives in Oporto (one of them, the procurador) who is my cousin. I am in the process of selling one of the properties but my cousin failed to register the land and I am now having to pay a lawyer in Serta to correct this error. Fortunately the buyers understand are still continuing with the purchase. Building has started on the second property in Dornes. Essentially, I would like to move the Company HQ, change accountant and remove my cousin from his role as procurador of the company. I have sought advice about closing down the company but am told that I cannot do this now that I have commenced construction in Dornes. I am told I have to wait until I have sold the property before I can close down the company. Do you know anyone who I could trust to look after my affairs in Portugal and what is your advice? Thanks very much Question from elizabeth smillie on 03/05/2011

  186. Dear Claudia, I intend starting a small business in Portugal, is it possible to register the company name in the uk then operate in portugal? I have tried to register the business name Atlasps property services with the portuguese authorities but, they rejected it and only offered me a list of disused portuguese busines names none of which were suitable as, my client base will be uk owners of holiday accomodation. Prior to the registration process, I did a lot of promotional work IE leaflet drops, corporate clothing website etc etc it will be a big expense to lose just for a name change! (the website is www.atlasps.org if you wish to view it) Also, a Portuguese accountant told me that, even though I have over 30 years of NI contributions in the uk I would still have to pay Portuguese NI is this correct? Finally, if I registered the business in uk can I pay Tax in Portugal, I'd rather pay into their system if I'm getting business from their tourism- only fair! Kind regards, Alan Whittle. Question from alan whittle on 22/03/2011

    Claudia says:

    Hello Alan
Thank you for your question. I didn't understand from your question, if you want to open a company here in Portugal, to expand your business, with the name that you already have Atlasps. If this is the case and I observed that the name is available, we must provide the register, and than open the company.I don't know if you are still making your NI contributions in the UK, but if you are not and open a company here in Portugal you must pay social security here. If you register your business in the UK, you must pay taxes in the UK. I'm available to speak with you

  193. We own a piece of land in Portugal that we would like to sell part of. Is possible to do this? We had heard that you could not divide any land and only sell some of it. Thank you. Question from Cathy Chapman on 10/10/2010

    Claudia says:

    Hello
Thank you for your contact. We don't have a lot of information about your land, but in general if your land is register as one piece, when you want to sell you must sell all the land. If your land is divided into parts, you can sell each part. The division of the land is possible, and if you wish we can make a profound analyze. You must send the elements to my email geral@accountingadvantage.pt
